Acceptable Usage Policy

Our Acceptable Use Policy describes prohibited uses and acceptable practices relating to the use of HostFirst. It is shortly known as AUP. And also describes its partners' network of internet properties that include websites, online platforms, and applications. Besides that, it consists of the materials, products, and online services by customers of HostFirst. And also the users that have attained access to HostFirst services by visiting, registering accounts, and purchasing services.

The services must be used to align with the intended purpose of services and the terms of the applicable agreement with HostFirst. To add more, the use must be consistent with the Terms of Service to which the Acceptable Usage policy of HostFirst is incorporated by reference. The examples mentioned in this Acceptable Usage Policy are not exhaustive. We have the right to make modifications in AUP if we want by posting a revised version of our services.

By using the Services, You consent to be bound by the terms of the latest version of this AUP. For the ease of our customers, terms are clearly defined in our Terms of Services. You agree to comply with this Acceptable Usage Policy. You must need your end user to comply with this AUP. If we notice you violating or authorizing, or helping others doing so, we have the right to suspend or terminate the use of services. Also, we can delete your account if needed.

No Harmful, Illegal, or Offensive User Content

You may not use, facilitate, encourage, promote, or instruct others to use the Services for any misuse. It is done to prevent unlawful, fraudulent, illegal, harmful, infringing, criminal, or offensive use or enterprise or transmit, display, store, or distribute. Or otherwise, to make information or content available, that is unlawful, harmful, abusive, illegal, fraudulent, or infringing. All the prohibited activities or content include:

Illegal, Harmful, or Fraudulent Activities:

Any activities that are infringing, illegal that can violate the rights of others, or that may be harmful to others in any way. All illegal or fraudulent activities that can harm our reputation or operations include disseminating, facilitating, or promoting child pornography, disseminating or offering fraudulent services, goods, promotions, or schemes. They also include phishing, make-money-fast schemes, and pyramid schemes.

Infringing Use of Content:

Content that misappropriates or infringes the intellectual property or proprietary rights of others. They include unauthorized disclosures of private information or collecting information directly from HostFirst and our Users. They may use it for your own personal or business purposes without permission or any proper attribution. You agree not to try reselling HostFirst's products and access to the Services it offers without our written permission.

Offensive Content:

Content that can be harmful to minors in any way is prohibited. This content may include abusive, libelous, threatening, harassing, obscene, defamatory, or invasive of privacy. This list does not end here, and it further comprises patently offensive, false, discriminatory, and intentionally misleading. Otherwise, the objectionable content that provides for content constituting relates to bestiality, child pornography, or depicts non-consensual sex acts. Besides, it also includes the content promoting hatred, misogyny, racism, bigotry, religious intolerance, or physical harm to any individual, group, or animal.

Harmful Content:

Any content or computer technology that may cause any damage interferes with surreptitiously intercepting. Or the one that may expropriate any program, System, or data, including time bombs, Trojan horses, viruses, and worms.

False Content:

The submission of any content or information that falsely impersonates, states, or otherwise misrepresents the identity. It may also include misrepresenting the current or previous qualifications, or your affiliations with an entity or a person, past or present, or assuming the identity of another.

No Email, SPAM, or Other Message Abuse

You agree to comply with our Anti-Spam Policy all the time. You will not publish, distribute, send, or facilitate the sending of unsolicited mass emails. Besides emails, it also includes other messages, advertising, promotions, or solicitations, including informational announcements and commercial advertising. Without the sender's explicit permission, you can not obscure or alter the mail headers or assume the identity of a sender.

To add more, HostFirst users will not collect replies to the messages from another internet service provider if they violate this AUP or an appropriate use policy of that particular provider. To market other opportunities or businesses unrelated to our services, you can not use our communication tools. These tools include feeds, forums, or messages.

No Security Violations

You may not use our Services to violate the security or integrity of any network, communications system, software, software application, network, or computing device. Prohibited activities include:

Unauthorized Access:

Using or accessing any System without our permission, including attempting to scan, probe, or test the vulnerability of a System, comes in the category of prohibited tasks. Also, it consists of trying to breach any authentication or security measures used by a System.

Interception:

Monitoring of traffic or data on a System without permission.

Falsification of Origin:

It is forging email headers, TCP-IP packet headers, or any other part of a message describing its route or origin.

No Network Abuse

You are not allowed to make network connections to any hosts, Users, or networks unless you have a permit to communicate with them. Prohibited activities under this category are:

Monitoring or Crawling:

Crawling or tracking a System that disrupts or impairs the System being crawled or monitored.

Denial of Services (DoS):

Inundating a target with communications requests so the target responds so slowly that it becomes ineffective or cannot reply to legitimate traffic.

Intentional Interference:

Interfering with the functioning of any System, including any attempt to overload a system by news bombing, mail bombing, flooding techniques, or broadcast attacks.

Operation of Certain Network Services:

Operating network services like open mail relays, open proxies, or open recursive domain name servers.

Avoiding System Restrictions:

Using electronic or manual means to avoid any use limitations placed on a System. They may include access and storage restrictions.

Excessive Use:

In the event any instance makes excessive use of CPU from activities. These activities include cryptocurrency CPU mining; HostFirst reserves all the rights to limit the CPU available to your representatives to maintain a consistent level of performance on all the nodes.

To put it in crystal clear words, users agree to:

(i)Comply with this Acceptable Usage Policy
(ii)Comply with all laws and regulations applicable to you, including intellectual property laws, export control laws, without criminal laws, limitations, privacy laws, tax laws, and regulatory requirements of your respective field
(iii) Use the Services a professionally

Our enforcement and monitoring

We reserve all the rights to investigate violations of this AUP or misuse of the Services but do not take it as an obligation. We can:

(i)Investigate violations of this Acceptable Usage Policy or misuse of the Services offered by HostFirst.
(ii)Review any User Content, disable access to, remove, or modify any resource or content that can violate this AUP. We have the right to monitor any other agreement we have with users for the usage of our Services;
(iii)Monitor all prohibited actions, and investigate them. Additionally, we can take appropriate action at our sole discretion against you.

If we notice a violation of this AUP or other provision of the Terms of Service, we may terminate or suspend your account. Also, we can check your access to services or any portion of services without notifying you of violation. We have the right to take legal action to enforce our rights and report you to regulators, law enforcement authorities, or any other appropriate third parties.

Kindly beware that we cooperate with reporting suspicious and law enforcement or illegal activity.

In reporting, we can unveil your personal information. To add more, we cooperate with regulators, law enforcement agencies, or other appropriate third parties. They help us prosecute and investigate illegal conduct by providing information related to the violation of this AUP.

According to the Privacy Policy of HostFirst, we can share or use your information for various purposes. These purposes may include the safety, property, rights, or security of HostFirst, any third party, our services, or the general public. This is meant to prevent, detect, or otherwise address fraud, cyber-crimes, cyber-security, security, or technical issues. Also, it can avoid any activity that HostFirst may take to be posing any risk of being unethical, legally actionable, or illegal. Besides, it can be used as evidence to conduct audits, litigation, or enforcement of the Terms of Service and Acceptable Use Policy of HostFirst.

HostFirst does not endorse the Services' content, information, or message found. It expressly disclaims any liability to the Services and any actions that result from user participation in any Service. HostFirst must have no obligation to maintain content after termination of our Services.

Reporting of Violations of this AUP
